DEFINITIONS

In these Terms of Use the following definitions are applied:

  1. Terms of Use — these terms and conditions of use
  2. Client — a customer purchasing the Products in the shop squva.pl
  3. Online Shop — squva.pl website
  4. Products — all items offered for sale in the shop squva.pl
  5. Sales contract — an agreement between the Client and the Seller for which the Act on Protection of Certain Consumer Rights and on the Liability for Damage Caused by Hazardous Products of 2 March 2000 is applied
  6. Order — A confirmed request of the Client determining model and quantity of the Products leading to entering into Sales agreement on distance via the Online Shop

GENERAL TERMS

  1. A condition for placing the Order in the Online Shop is the review and acceptance of these Terms of Use.
  2. The Online shop squva.pl is operated by the Seller and enables purchasing goods via the Internet.
  3. The products sold on the Online Shop are detailed in full. The website provides information on the product’s quality, price, materials they are made of and other details.
  4. The protection, provision and record of essential terms of the contracts concluded by means of distance communication is done by printing and transfer to the Client the proof of purchase (invoice) or the specifications of purchased Products and their delivery.
  5. The Online Shop users are obligated to:

  • abstain from submitting or transmitting unlawful content
  • abstain from using the Online Shop in a way that interferes with its operation
  • use the Online Shop in accordance with the Law of the Republic of Poland, the regulations of the

PLACING ORDERS

  1. All prices on the squva.pl website include VAT and are given in Polish zloty. Given prices do not include delivery costs.
  2. Free domestic Inpost shipping for orders over a 300 zł amount. International shipping according to the international tariff.
  3. Clients can place an order 24 hours a day, 7 days a week. Orders placed during weekends and holidays will be fulfilled on the first working day after the order is placed.
  4. The Client can place an order without having to register his or her personal data (purchases without registration).
  5. A condition for placing an order is filling in the order form available on the Online Shop website, providing all the necessary data required for shipping and for generating an invoice.
  6. To place an order the Client chooses a Product from the Online Shop, selects a color, size and quantity and adds them to “Cart”.
  7. Prior to the moment of accepting the Product by clicking on the command “Confirm Order” the Client can make changes to the order, including a change of the purchase and modification of the information required for shipping or generating an invoice.
  8. The confirmation of an order (by clicking the command “Confirm Order”) is equivalent to the Client entering into a Sales Contract with the Seller, in accordance with Terms of Use.
  9. After an order has been placed the Client will receive a notification on the Online Shop website and also via email, providing all the information regarding the purchased items, including quantity, their value, the shipping method, payment method, timeframe for delivery and the contact information provided by the Client when placing an order. The notification represents the confirmation of a sale contract.
  10. The Sales Contract is drawn up in accordance with these Terms of Use.
  11. The Client has the right to resign from an order before receiving the order confirmation. In order to do this the Client should contact the Online Shop as soon as possible by email or telephone and inform the Online Shop about cancelling an order.
  12. The Online Shop reserves the right to refuse to process an order under the Sales Contract in the case when the Client’s contact data is false or the transaction has not been authorized within the electronic payment system eCard or payment has not been paid within the specified time frame.

COSTS, SHIPPING AND DELIVERY

  1. Products are sent to the address indicated in the Order.
  2. Products are delivered by the shipping companies. The delivery time indicated in the order confirmation is the most probable time within the order is accomplished. Shipping fees are given in the course of confirming and processing the payment. Expected time for delivery is one working day from the day of dispatch the parcel. Total and maximum time for fulfillment of the order should not be longer than 14 working days and under no circumstances longer than 30 days from the day the order was placed. The shipment of the order can be delayed, if pre-payment is chosen as a payment method, until the payment for the order (and shipping fees) is processed by e-Card or bank transfer. For payment card transactions, the order will be processed after payment authorization by the card issuer.
  3. When accepting the delivery from the shipping company, the Client should check the package and contents carefully in a shipping agent presence. In case of damage, the Client should draft a damage report in two copies, both signed by the shipping agent and the Client.

PAYMENT OPTIONS

  1. Cash on delivery (COD) in case of delivering the products by shipping company
  2. By bank transfer via online banking to the bank account indicated by the Seller
  3. By electronic payment (eTransfers, direct transfer) – After choosing payment method the Client will be redirected to the bank’s transaction service. After logging in, the Client will be presented with a pre-filled money transfer form with a proper amount, a transfer name, and recipient’s data. After accepting a transfer the Client will be redirected back to the Online Shop website.

GUARANTEES, CLAIMS AND RETURNS

  1. The Products offered for sale in the Online Shop are new and genuine. Products photos are only tentative. Custom made items cannot be returned or exchanged.
  2. The client has the right to withdraw from the Sales Contract without any reason within 14 days of receiving his or her order, according to the Act on Protection of Certain Consumer Rights and on the Liability for Damage Caused by Hazardous Products of 2 March 2000 (Journal of Laws No. 22, item 271, as amended).
  3. A condition of accepting the return is making a declaration about withdrawing from the Sales Contract and delivering it along with the product to the Online Shop address within 14 days from the day of receiving the Product. The returned item must be unused, clean with an original label, without any fragrance.
  4. To accept returned product by the Seller, a returned item must be complete, not damaged, with an intact seal protecting from using.
  5. The price of the product will be refunded to the Client within 14 days from the day the returned item is received by the Seller. If a payment was done by a payment card, the refund will be made onto the Client’s card.
  6. The Seller is accountable as a sales agent to the Client under the terms of Article 221 of the Civil Code for any discrepancies in the items purchased by the Client with regard to the Sales Contract in the period established in the Law on certain conditions of consumer sales and changes in the Civil Code of 27 July 2002.
  7. Any damage or flaw in an item purchased in the Online Shop can be claimed within the timeframe and conditions provided by the Terms of Use. A claim may be filed by filling out the “Claim” form and submitted by the shipping companies, along with the shipment of the items to the Online Shop to the address 8A Klimczaka Street, apartment 30, postal code 02-797 Warsaw. The Client must cover the shipping fee of returned product.
  8. The Client will receive an information about possible ways of considering a claim within 14 days from the day of receiving product by the Seller.
  9. In the case when the Seller does not relate to the claim reported by the Client within 14 days from the day the returned item is received by the Seller, the claim is supposed to be admitted by the Seller.
  10. In the case of damage to the product in transit, the client should fill out a damage report together with the shipping agent. Claims on items damaged in transit will only be processed on the basis of the damage report.
  11. Shipping cost of changed Product to the Client address covers the Seller (after admitting the claim).
  12. In the case of returning the Product according to withdrawing from the Sales Contract or admitted claim, refunded costs include the Product’s price and shipping fees paid by the Client.

PRIVACY POLICY

  1. Pursuant to the Act on Protection of Personal Data of 29 August 1997, the Seller as the administrator of data given by the Client guarantees the security of the personal data which was gained in the process of an order fulfillment.
  2. The Seller processes the personal data only for the purpose of processing and fulfilling a purchase order, generating an invoice and for shipping.
  3. Pursuant to the Act on Protection of Personal Data of 29 August 1997 (Poland, Journal of Laws [Dz.U], 2002, No. 101, Item 926, as amended), the Client has the right to demand completing, upgrading, correcting his or her personal data, delaying its processing temporary or permanent and deleting it if the personal data is incomplete, false or was gathered with the law violation

OTHER

  1. Sales Contracts in the Online Shop are concluded in accordance with Polish law.
  2. Issues not regulated by these Terms of Use are subject to the laws of the Civil Code or other legislation related to the activities and operations of the Online Shop.
  3. The designated court for any disputes is the local court for the Online Shop, according to the binding legislation for that particular jurisdiction.
  4. The Seller reserves the right to make changes to the Terms of Use at any time. If the Client entered into Sales Contract before such changes were implemented, the Terms of Use version applied at the moment of placing an order is used. Changes are effective from the moment they are published on squva.pl website.
  5. The Seller informs that all photos, publications and texts available on the Online Shop website are protected according to the Act on Copyright and Neighbouring Rights of 4 February 1994. Visual symbols, logos, buttons, pictures and their compilations which are the administrator’s property are also under the protection. Copying or diffusing of the contents stated on the Online Shop website is prohibited.
